Roland X. Tiemann - Experienced, Affordable, Aggressive, Dedicated, Northern California DUI Defense Lawyer

Non-Resident DUI Defense Attorney

Non-Resident DUI

If you are arrested for a DUI while in California but have an out-of-state license, the arresting officer will not take your license as with a California resident.  You will be given a notice that your license will be suspended in 30 days unless you request a hearing with the California DMV to contest the suspension.  You have 10 day from your arrest to make this appointment.  You should also ask for a stay of suspension when you contact the DMV.  This postpones the suspension pending the outcome of the hearing.  You should speak to a Sacramento DUI defense lawyer at the Tiemann Law Office about your rights in this matter.  We can represent you for your DUI and if your charge is a misdemeanor, we can represent you without you having to appear in court.

It is important for you to have a lawyer who is experienced in non-resident cases because if your decide to resolve your case it can often be resolved without you having to do California jail time or a California DUI class as part of your probation.  Most states have an agreement to share an individual's driving record with other states.  If you receive a DUI conviction in another state, it should appear on your own state's DMV record.  You may be lucky and it will not appear on your state's records.  If it does, you will be subject to the penalties normally imposed for a comparable DUI conviction.  Because of this, it is important to fight a CA DUI charge.

Non-Resident DUI Lawyer in Sacramento

If you plan to return to California, you need to take steps to ensure you will be permitted to drive while here.  You need to file a form with DMV that you are a resident of another state.  When you do return to California, you can have your driving privileges restored either after three years of after you have successfully completed a DUI program.  If you have a warrant on a California DUI for not appearing or resolving your case we can help you get the warrant cleared so that you will be in good standing with the court.

Contact a Sacramento Non-resident DUI Defense Lawyer for help with the DMV and resolving your California DUI charges.  We can represent you without you needing to appear in court.
